PS: Here’s a REALLY quick story… When I first started off, it took me over a year and a half to even get my first house under contract. Yeah – it’s embarrassing to admit. Why did it take me so long? FEAR. I was scared of making a mistake that would result in a lawsuit. Simple as that. I conquered my fear by gaining an understanding in how contracts can protect me from liability. Once I realized that, and had contracts that I could use to control houses RISK FREE, I was off to the races and I’ve gone on to close more than 400 houses! I constantly have a steady stream of wholesales, lease options, rehabs, new construction and anything else I can get my hands on. As previously stated; all of these strategies (and many more I have not mentioned in this article) have their place and can make money. However, for the new investor, dead set to make the millions of dollars promised by the “Gurus,” focus on Options and Wholesale deals.

July 14, 2016 at 1:28 am In the event the property is being rented and their is a long term lease (not month to month), you will need to make a concession to the tenant to make sure they cooperated with the transfer of ownership. This is what I mean by that statement; In most states the lease agreement transfers with the ownership, so if you purchase a property and the tenant have 7 months left on the lease then you have to honor that lease. To avoid this we offer the tenants a cash for keys (CFK) agreement. This is a one page agreement stating that the buyer will offer the tenant money to vacate the property. This is basically offering to pay for the tenants moving expenses. This is negotiable it can be what ever amount you agree upon. Again this is between the new buyer (wholesaler) and the tenant. We inform the seller what we will offer the tenant but this agreement will need to be signed by the legal tenant and the wholesaler.

Wholesalers will use their own contract so they can include certain language and clauses which are to their benefit. The first clause will give the wholesaler an out if they can’t sell the property. It says that if you haven’t found a buyer or a ‘partner’ as the contract words it, you are not obligated to purchase the property. This eliminates the risk of coming up with the money for the property if you can’t find an investor.
